Movember General Terms

This section sets out the terms that apply to your use of the Movember website. Your continued use of our website indicates to Movember that you agree with these General Terms. We may change these General Terms from time to time, so please check back regularly.

1. Content created by Movember - Movember owns or licences from third parties all of the trademarks, copyright and other intellectual property that exists in our website. You must not copy or reproduce in any form any of the graphics, logos or other material on our website unless you have our specific permission. For the avoidance of doubt, you have our permission to download material from the Downloads page on our website.
    
2. Content posted by you - Any content that you post to our website (eg photos and videos) is your responsibility, and you must make sure that you have the necessary rights to post that content (eg by obtaining permission of copyright owners if necessary). By posting any content, you also give Movember a non-exclusive, transferable, royalty-free worldwide right to use and reproduce that content.
    
3. Keeping our website safe – We need your help to keep our website safe. Therefore, you must adhere to the following:
   
   a. You must not collect user’s content using automated means
   
   b. You must not upload viruses or other malicious code
   
   c. You must not bully, intimidate or harass anyone
   
   d. You must not post any content that infringes or violates someone else’s rights, or otherwise violates the law, or that is hateful, threatening, pornographic or violent
    
4. Movember’s disclaimer – Movember takes great care with its website and we endeavour to keep it accurate, error-free, and free of any offensive material. However, you use the site at your own risk and Movember will not be liable for any costs or losses you incur through your use of our website. Whilst we may include on our website links to third party websites or resources, Movember is not responsible for such third parties and you use those websites or resources at your own risk.
    
5. Hosting a Mo Party – if you register to host a Mo Party, we are happy to provide you with the materials in the Mo Party Kit, but organising and running the Mo Party is your responsibility. You will be responsible for taking care of all permits, permissions or other similar issues arising from the Mo Party that you organise and Movember will not have any liability in relation to any injury, damage or loss at a Mo Party.
    
6. Gala Parté Tickets – if you attend a Gala Parté, you will need to comply with the terms that are printed on the tickets.
    
7. Refunds – Movember is happy to refund your donation if you have made it in error. If you wish to request a refund then please contact us using the contact details in the Contact Us section of the Movember website relevant to the country in which you live.
    
8. Movember’s rights - Movember may remove any content posted by you, or prevent access by you to our website if you do not comply with these General Terms. Any failure by Movember to enforce our rights under these General Terms if you do not comply is not a waiver and we remain entitled to enforce our rights in relation to that or any other non-compliance by you.
    
9. Entities and governing law – the Movember entity and relevant law governing these General Terms depends on the country in which you live:
   
   a. If you live in the USA, these General Terms form an agreement between you and Movember Inc. subject to the laws of California, USA;
   
   b. If you live in Canada, these General Terms form an agreement between you and Movember Canada, subject to the laws of Ontario, Canada;
   
   c. If you live in a country that forms part of the European Union, then these General Terms form an agreement between you and Movember Europe, subject to the laws of England and Wales; and
   
   d. If you live in Australia, or in any other place not covered by paragraphs a, b, or c above, then these General Terms form an agreement between you and The Movember Group Pty Ltd, subject to the laws of Victoria, Australia.

Terms & Conditions – Movember Inc. Mo Sista $50 draw

1. Entry into this “Competition” is deemed an unequivocal acceptance by you to be bound by these terms and conditions. Movember Inc. (“Movember”) may revise or modify these terms and conditions at any time by posting revisions thereto without prior notice or consent. You will be bound by the revised terms and conditions for all subsequent engagement in the Competition. Specifically, your continued use of www.movember.com (the “Site”) following our posting of any modifications constitutes your acceptance thereof. If you do not agree with these terms and conditions, please do not participate in the Competition and stop using the Site.
    
2. By entering into the Competition, you are warranting and representing that you are at least 18 years of age and that you may enter into and form binding contracts under applicable law.
    
3. To enter the Competition, you must register as a “Mo Bro” or “Mo Sista” at the Site. The Competition will consist of each Mo Bro or Mo Sista getting his or her friends and family to donate monies directly to Movember at the Site into the account of that specific Mo Bro or Mo Sista. Movember does not intend for the Competition to be a raffle or lottery and as such, Movember does not intend for any Mo Bro or Mo Sista to pay any consideration to be entered into the Competition, but instead intends for each Mo Bro and Mo Sista to have his or her friends and family directly donate money into his or her account.
    
4. The Competition commences at 9am PST on Tuesday 1 November 2011 and concludes at 2pm PST on Thursday 8 December 2011.
    
5. Movember grants a limited license to each Mo Bro and Mo Sista of the Site to make personal use only of the Site in accordance with these terms and conditions. This license expressly excludes, without limitation, any reproduction, duplication, sale, resale, or other commercial use of the Site.
    
6. Those Mo Bros and Mo Sistas who raise more than $50 for Movember will be automatically become eligible for the Competition reward and will be notified of this by Movember via email. There is a limit of one entry per Mo Bro and Mo Sista.
    
7. Employees and related parties of Movember are not eligible to enter the Competition.
    
8. Movember reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process. Further, by entering the Competition, you hereby acknowledge and agree that Movember may, in its sole discretion, terminate or suspend your access to the Site and your participation in the Competition, with or without notice, and for any reason, including, without limitation, breach of these terms and conditions. Any suspected fraud, abuse, or illegal activity may be grounds for terminating your access to the Site and your participation in the Competition and may be referred to applicable law enforcement authorities.
    
9. The winner of the Competition will be determined by a random draw of eligible Competition entrants. This will take place at approximately 2pm PST on Thrusday 8 December, 2011 at the premises of Movember or its authorised agent at 178 Albert Street, Windsor, 3181, Australia.
    
10. There are seven reward packages to be won. Each reward package consists of a moustache necklace from the Demitasse “Precious Metal Demistache Moustache” Collection. The total value of the reward is up to $165 USD.
11. The reward is not redeemable for cash or other products and is not transferable. The reward can only be claimed by verbal or written acceptance by the winner. The reward will be delivered to the winner by 1/31/12 if the reward is claimed by the winner.
     
12. The winner will be notified by email on Friday 9 December, 2011. The name and suburb of the winner will be published on the Site by Monday 12 December, 2011 and will be included in Movember’s broadcast email on 15 December 2011.
     
13. If the reward is not claimed by Thursday 15 December 2011 the reward will be forfeited and Movember will award the reward to another entrant, drawn randomly in the same manner as set out in condition 6. The same individuals will be eligible for this second drawing, excluding the winner of the first drawing who failed to collect the reward.
     
14. If for any reason Movember is not capable of running the Competition as planned, then subject to any compulsory law to the contrary, Movember reserves the right to cancel or modify the Competition in its sole discretion.
     
15. All entries into the Competition will become the property of Movember. All information contained in the entries and details of the winner will be held in accordance with the Movember Privacy Policy, which can be accessed by visiting the Site. By entering this competition, all Mo Bros and Mo Sistas acknowledge that they are in agreement with the Privacy Policy and all of the terms contained therein.
     
16. The Competition will be run by Movember at 1518 Abbott Kinney Blvd, Venice, CA, 90291.
     
17. By entering into the Competition, you agree that the laws of the State of California govern the competition and/or use of the Site as well as these terms and conditions, without giving effect to any principles of conflicts of laws.
     
18. These terms and conditions constitute the entire agreement between Movember and you pertaining to the Competition. In its sole discretion, Movember may modify these terms and conditions by posting the revised version on the Site.
